This sets out how Morton Kyle Limited uses and protects your information, once you have submitted your details to us. You may have done this via a business card exchange, event attendance, via our promotions page or in exchange for some of our free reports and offers, or any other legitimate and legal engagements.

Morton Kyle Limited is committed to maintaining the highest level of security with respect to you data and its protection, and any data provided to us is held with in accordance with the ICO regulations and terms.

This policy is valid immediately as of August 2013.

Typically, we will collect name, email and telephone contact details, typically, so you can receive the information you have requested.

On an infrequent basis we may also contact you to engage in prospect and customer surveys where we may collect additional information regarding your preferences, business challenges and specific needs.

Comments on our webpage

Visitor comments may be checked through an automated spam detection service.

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognise and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

Contract Terms for Training

Your training must be paid for, cleared funds, 14 days before the training takes place. You can pay by cheque or bacs, please contact us for our bank details.

Non Attendance – Open Courses Should you fail to attend, you will be charged the full rate for your place on the day. There is no refund policy for open courses. You are welcome to send another person instead and let us know the name of the replacement attendee. There is no charge for this change.

Non Attendance/Cancelling Bespoke/On Site Courses Should you cancel a program, you may be entitled to a refund depending on the notice you give us.

All cancellations should be notified by telephone to 0114 236 1221 or 0779 002 1885, and followed up by email to carol@mortonkyle.com and acknowledged by Morton Kyle Limited by email.

We are not able to accept verbal notification only.

  • If you cancel 15 working days or less before the date of delivery, you will incur a cancellation fee of 25% of the course fees
  • If you cancel 10 -14 working days before the date of delivery, you will incur a cancellation fee of 50% of the course fees
  • If you cancel 0 – 9 working days before the date of delivery, you will incur a cancellation fee of 100% of the course fees.

Any discounted courses/places on any (open or bespoke) courses have a no-refund policy in place at the time of booking. 

Course Transfers Course transfers may not be allowed due to the tight schedules that are run within the business. Courses that are subsequently transferred to alternative dates are still subject to a the cancellation policy detailed above.

Changing Attendee Details Should you wish to substitute one attendee for another from your organisation on the day of training – please let us know the change and we will amend our records accordingly. There is no charge for this change.

Cancellation of Courses by Morton Kyle Limited Morton Kyle Limited reserves the right to cancel the course at any time without liability. In the unlikely event of this happening, we will issue you with an alternative date, full refund, or a credit note.

Ownership – all course material and any content delivered during the program is wholly owned by Morton Kyle Limited. This ownership is not conferred to the associate, individual or client organisation unless written confirmation is obtained from the Principal of the company. This may incur a fee. Failure to observe this will result in immediate legal action being taken against the individual and the organisation involved. We operate a zero tolerance policy on copy, redistribution and any infringement of our material.

Legal Notice Course notes and training cannot be relied upon for legal interpretation.  Morton Kyle Limited do not accept responsibility for attendee actions or those of other people reading the training in litigation, or responsibility for loss incurred as a result of relying on the training or training notes.

The intellectual property and copyright of the training material and any associated materials used during the course remains the sole property of Morton Kyle Limited. Course material may be distributed to the course attendees for their own private use and reference and should not be transmitted, copied or distributed via any other means.

To do this would breach the conditions of engagement and will  result in legal action being taken against the organisation. These rights maybe transferred to the client company by special arrangement which may include a fee. Please contact us for details.
